Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between ITI Symmetrics ApS, trading as MySoMeData ("we," "us," or "our"), and you, whether personally or on behalf of an entity ("you" or "user"), concerning your access to and use of our website, platform, and application programming interfaces (collectively, the "Service").
Please read these Terms carefully before accessing or using the Service. By accessing, registering for, or using the Service (including accessing the API), you agree to be bound by these Terms. If you do not agree to all of these Terms, you are expressly prohibited from using the Service and must discontinue use immediately.
1. Acceptance of Terms
By creating an account, connecting a social media account, or accessing our developer API, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. We reserve the right to update or modify these Terms at any time. We will notify you of material changes by updating the "Last Updated" date at the top of this document or via email. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms.
2. Subscription, Billing, and Cancellation
A. Subscription Model and Recurring Billing
Access to the Service, including the API, is provided on a subscription basis for a recurring monthly or annual fee ("Subscription"). By signing up for a Subscription, you authorize us to charge your designated payment method on a recurring basis. All payments are processed securely through our third-party payment processor, Stripe. You agree to provide current, complete, and accurate purchase and account information.
B. Cancellation Policy
You may cancel your Subscription at any time through the customer billing portal provided within your account dashboard. Upon cancellation, your subscription will remain active, and you will continue to have access to the Service, until the end of your current billing cycle. No further recurring charges will be made to your payment method after cancellation.
C. Refund Policy
Except as required by applicable law, all payments are non-refundable. We do not provide refunds or credits for partial subscription periods, unused API calls, or immediate cancellations. If you believe there has been a billing error, please contact us at support@mysomedata.com within thirty (30) days of the charge to request an evaluation.
3. API License, Usage, and Restrictions
A. License Grant
Subject to your compliance with these Terms and your timely payment of all applicable Subscription fees, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use our developer API solely to retrieve aggregated performance metrics for your internal business purposes or integration into your own software applications.
B. Fair Use and Rate Limiting
To protect our infrastructure, maintain service quality, and prevent abuse, we enforce rate limits and "Fair Use" thresholds on API requests. These limits are defined in our documentation or based on your subscription tier.
- We reserve the right to temporarily throttle, limit, or suspend your access to the API without prior notice if your usage exceeds reasonable thresholds or threatens the stability of our servers.
- You agree not to bypass, attempt to bypass, or systematically circumvent any rate-limiting mechanisms we have put in place.
C. Prohibited Conduct
You agree that you will not, and will not permit any third party to:
- Reverse-engineer, decompile, disassemble, or attempt to extract the source code or underlying algorithms of the Service or API.
- Use the Service, API, or extracted data for any illegal, unauthorized, or fraudulent purposes.
- Resell, lease, sublicense, or distribute raw API access or data to third parties in a manner that competes directly with our Service.
- Use any automated system, robot, spider, or scraper to access our platform interface, except as explicitly authorized through our official developer API.
4. Platform Dependencies & Limitation of Liability
A. Third-Party Platform Dependency Disclaimer
Our Service relies entirely on the availability, functionality, policies, and open developer APIs of third-party social media platforms, specifically Meta (Instagram), TikTok, and Pinterest ("Third-Party Platforms").
You acknowledge and agree that:
- The availability of metrics and data depends on the continued cooperation and API availability of these Third-Party Platforms.
- Third-Party Platforms may update their APIs, modify their terms of service, impose strict rate limits, deprecate features, change permission scopes, or revoke our developer credentials at any time with or without notice.
- We are not responsible or liable for any service interruptions, data inaccuracies, loss of functionality, or complete loss of access to metrics caused directly or indirectly by changes, outages, policy shifts, rate limits, or terminations imposed by these Third-Party Platforms.
B. Warranty Disclaimer
The Service and API are provided on an "as-is" and "as-available" basis without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation.
C. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall we, our affiliates, or our service providers be liable for any indirect, incidental, special, consequential, or exemplary damages, including but not limited to loss of profits, loss of data, loss of goodwill, or business interruption, arising out of or in connection with your use of or inability to use the Service.
Our total cumulative liability to you for any claims arising out of or relating to these Terms or the Service shall be limited to the total amount of subscription fees actually paid by you to us in the twelve (12) months immediately preceding the event giving rise to the liability.
5. Account Suspension and Termination
We reserve the right, in our sole discretion and without prior notice or liability, to suspend, throttle, or terminate your account and access to the Service (including the API) under the following conditions:
- You violate or breach any provision of these Terms or our Privacy Policy.
- You fail to pay any fees due for your Subscription.
- Your usage patterns represent a security threat, cause excessive load on our infrastructure, or involve suspected fraudulent activity.
Upon termination, your right to use the Service and the API license granted under Section 3 will immediately cease. Any provisions of these Terms which by their nature should survive termination shall survive, including but not limited to intellectual property ownership, platform dependencies, disclaimers, and limitations of liability.
6. Intellectual Property Rights
A. Our Intellectual Property
We retain all right, title, and interest in and to the Service, including all software, API designs, databases, code, website designs, graphics, branding, trademarks, and logos. Nothing in these Terms grants you any ownership rights in our technology or intellectual property.
B. Your Data and Credentials
You retain all ownership rights in the credential data, account profiles, and raw metrics associated with your connected social media accounts. By connecting your accounts via OAuth, you grant us a worldwide, non-exclusive, royalty-free, and limited license to access, aggregate, and process this data solely as necessary to provide the Service and deliver the API metrics to you.
7. Governing Law and Severability
These Terms and your use of the Service shall be governed by and construed in accordance with the laws of Denmark, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts of Copenhagen, Denmark, and you consent to the personal jurisdiction and venue of such courts.
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms shall remain in full force and effect.
